According to Politico, Facebook internal documents (dated 2021) contradict the assessment derived from recent ruling of the Court of Justice of the European Union (CJEU) in relation to data transfers. One of these documents for instance argue that "the conclusion of the Equivalence Assessment is, in summary, that relevant U.S. law and practice provides protection of personal data that is essentially equivalent to the level of protection required by EU law." Facebook lawyers also argue that recent court rulings (including on the EU-US Privacy Shield) "should not be relied on" for the social media company's own assessment of data transfers to the U.S., because they relate to the Privacy Shield, and not the Standard Contractual Clauses (SCC) which Facebook uses to transfer data to the U.S.
