In 2014, the Federal Trade Commission (FTC) sued AT&T for slowing down the data speed of customers who had unlimited data plans. The issue here was whether the FTC has jurisdiction to oversees their practices, since AT&T as a common carrier is under the supervision of the Federal Communications Commission (FCC). The FTC argued that in this manner, phone companies can mislead consumers about their other related services, or even bypass FTC supervision by merging with other companies. Taking all that into account during the appeal process, theNinth Circuit court of Appeals ruled that the FTC will have the power to supervise Internet service providers as well, especially with respect to consumer protection, data protection issues and anti-competitive practices.
